Why Your New Jersey Car Accident Settlement Requires a Charles Jones Search

By Rose Harper Law | Tri-State Personal Injury Attorney

You've been in a car accident in New Jersey. You've hired an attorney, treated with your doctors, and after months of negotiations, you've reached a settlement. You're ready to receive your check — but before a single dollar can be placed in your hands, your attorney must complete one more mandatory step: a Charles Jones Child Support Judgment Search.

If you've never heard of this, you're not alone. Most personal injury clients in New Jersey are surprised to learn that this legal requirement exists and that it applies to every settlement over $2,000. At Rose Harper Law, we believe you deserve to understand every step of the process — including this one. Here's everything you need to know.

What Is the Charles Jones Search?

The Charles Jones Child Support Judgment Search is a certified database search that checks whether you — the person receiving a personal injury settlement — owe any outstanding child support judgments that have been docketed in New Jersey's court system.

Charles Jones, LLC is a New Jersey-based data company that has been the industry standard for certified judgment searches since 1911. Their search checks records across the New Jersey Superior Court, the U.S. District Court for New Jersey, and the U.S. Bankruptcy Court for New Jersey. When it comes to child support specifically, their database pulls directly from records filed by the Probation Division of the Superior Court.

Why Is This Search Required by Law?

This requirement isn't a firm policy or industry custom — it is a legal mandate under New Jersey state law. New Jersey's child support lien statute, N.J.S.A. 2A:17-56.23b, establishes that any outstanding child support judgment is a lien against the net proceeds of a civil settlement, judgment, arbitration award, inheritance, or workers' compensation award. In plain terms: if you owe child support, those funds have a legal claim on your settlement money before you do.

The legislation behind this requirement was codified through Senate Bill S2348. The law went into effect on August 14, 2000, and covers all settlements disbursed after that date — regardless of when the accident occurred.

Who Does This Apply To?

The search is required in virtually every New Jersey personal injury settlement, including car accidents, truck accidents, slip and falls, motorcycle accidents, and premises liability cases.

The Search Applies If: The Search Does NOT Apply If:
Net proceeds exceed $2,000 payable to an individual client. "Net proceeds" means the money left after deducting fees, costs, and medical liens. Net proceeds are under $2,000 after all mandatory case deductions have been calculated.
The recipient is an individual directly recovering civil or personal injury damages. The recipient is an entity such as a corporation, LLC, partnership, minor child, financial institution, or government entity.
Mandatory Information Required for the Search

Before your attorney can order the search, you must sign a certification providing the following details:

👤 Full Legal Name
📍 Mailing Address
📅 Date of Birth
🆔 Social Security No.

*Note: This search is strictly limited to New Jersey judgments. Out-of-state child support obligations do not appear unless formally docketed in NJ.

How the Process Works: Step by Step

Here is how the Charles Jones search fits into the overall settlement disbursement process for your New Jersey car accident case:

Step 1
Settlement is Reached

Your attorney and the insurance company agree on a final settlement figure, and a release agreement is signed.

Step 2
You Provide Your Certification

You provide your attorney with a signed form containing your verified name, address, DOB, and SSN.

Step 3
Your Attorney Orders the Search

Your attorney submits the request to Charles Jones. (By statute, the search fee is capped at a minimal $10 per name and is treated as a case expense).

Step 4
Charles Jones Runs the Search

The proprietary database searches dockets across the NJ Superior Court's Probation Division, accounting for variations in names to reduce errors.

Step 5
Results Are Returned

A certified search report is issued within 24 to 48 hours, yielding one of two paths forward:

Path 6A
If the Result Is Clear (No Judgments)

Your attorney can legally disburse your full net settlement proceeds. This distribution must occur within 30 days of the search date, or a new search is required.

Path 6B
If a Child Support Judgment Is Found Lien Action

Your attorney is legally required to contact the Probation Division to satisfy the judgment amount directly from the settlement funds. Your remaining balance is then safely disbursed to you.

How Long Does the Overall Process Take?

While the search itself takes only 24 to 48 hours, the total time to get your check depends on processing speeds from the insurance company and clearing the funds. In most straightforward cases where the search comes back clear, clients can expect to receive their settlement proceeds within **two to four weeks** of signing the release documents.

What Happens If My Attorney Skips This Step?

The statute is mandatory. If an attorney or insurance carrier distributes settlement funds without completing this search and a child support judgment existed, they can be held personally liable for the amount of the unpaid judgment. This ensures that every reputable firm takes this obligation seriously.
