If you've been injured in an accident, here's a quick breakdown of what to expect.
Step One: Immediate Action
Right after the accident: get medical attention, file a police report, take photos if you can, and call a lawyer immediately if you need one. Rose Harper Law, that's what I do, but early evidence gathering is important.
Step Two: Intake & Onboarding
We gather details about the crash, your injuries, and insurance. Once you sign a retainer agreement, we send letters of representation to the insurance company so they stop contacting you, allowing you to focus on your recovery.
Step Three: Treatment Phase
This is the longest phase. You’ll visit doctors, specialists, or get MRIs. Depending on the severity of injuries, treatment typically lasts between 2 to 12 months.
Step Four: Maximum Medical Improvement (MMI)
Once your doctor determines you've reached MMI (you've recovered or reached a stable point), it’s time to prepare the demand package and start negotiations.
Step Five: Demand & Negotiation
Gathering records takes 30-60 days. The insurance company then has 30-60 days to respond, followed by another 30-60 days of negotiation. From here, you decide: Settle or Litigate.
Step Six: Litigation (If necessary)
If we file a lawsuit, it doesn't always mean a jury trial. Through pleadings, discovery, and mediation, there are many chances to settle. Litigation can take 1 to 2 years to resolve.
